  1. DEFINITIONS:

"SITE" is the electronic store owned by "URBAN DESIGN" OOD, which is located on the domain www.urbanconcept.bg , through which it is possible to buy goods from a distance, offered in various catalogs by "URBAN DESIGN" OOD.

"SUPPLIER' is "URBAN DESIGN" LTD. This is a company registered under the Commercial Law of the Republic of Bulgaria with EIK 202785434, with headquarters in the city of Sofia and address of management in the city of Sofia 1404, SO - district "Triaditsa", g.k. "Gotse Delchev", bl. 256, entry In, app. 55.

"USER" is any natural or legal person using and visiting the SITE - www.urbanconcept.bg

"CLIENT" is any natural person over the age of 18 and any legal entity that has agreed to the General Terms and Conditions of www.urbanconcept.bg  and who placed an order through the WEBSITE of "URBAN DESIGN" OOD.

“USER PROFILE" - means a separate part on the SITE, containing information about the User, voluntarily provided by the User during his registration on the SITE.

"GOODS" – means the products offered by the Supplier through the Electronic Store – www.urbanconcept.bg

"PRICE OF GOODS" – means the price for 1 piece / m2 / l.m. in BGN for a certain amount of goods and including VAT and all additional taxes and fees. At the listed price are not included transport and delivery costs.

"ORDER" is the order placed by the Customer through the Electronic Store, for Goods selected by him, together with a selected method of payment and receipt of the Goods.

"PRICE OF DELIVERY" are the costs of transport and delivery of the Goods to the User, including value added tax. The price of the Delivery is not included in the price of the Product, which is offered in the Electronic Store - www.urbanconcept.bg!

"CONTRACT" – It is considered concluded at each CONFIRMED an order from a representative of the Supplier ("URBAN DESIGN" OOD).

"WORKING DAYS" are the days from Monday to Friday (from 10:00 a.m. to 19.00:10.00 p.m.) and Saturday (17.00:XNUMX a.m. to XNUMX:XNUMX p.m.). Sunday is a day off.

  1. INTRODUCTION:

The prices of some products in the online store of "URBAN DESIGN" OOD may differ from the prices in the physical objects of "URBAN DESIGN" OOD.

The promotions announced in the online store of "URBAN DESIGN" EOOD apply only to the online store and may differ from the promotions in the company's physical locations. All promotions are while supplies last. The sales are valid for all of the Supplier's outlets.

These General Terms and Conditions define the relationship between The supplier - "URBAN DESIGN" OOD and The users - buyers of goods offered on the SITE, when purchasing through a means of communication at a distance, without physical contact between the parties.

The SITE provides an opportunity to purchase - quickly and conveniently - goods selected by the user, which will be delivered to the address specified by the user in the country.

"URBAN DESIGN" Ltd. reserves the right to amend these GENERAL TERMS and CONDITIONS at any time, at its discretion. The modified GENERAL TERMS and CONDITIONS enter into force immediately and become binding for the USER from the moment of their publication on the SITE.

The use of the SITE's services can only be done for personal/non-commercial purposes. The use of the services for any other purposes will not be binding on the provider, nor the consequences thereof.

  1. USE OF THE ELECTRONIC STORE AND CHARACTERISTICS OF THE PLATFORM

The User should enter his e-mail address and his password for remote access by registering electronically on the Provider's website.

When registering, the User undertakes to provide correct and up-to-date data. in case of change, the User promptly updates the data specified in his registration.

The registration itself does not oblige the User to make certain purchases or additional actions.

When registering a profile, personal data is collected according to The privacy policy.

  1. TERMS FOR CONCLUSION OF CONTRACT - REGISTRATION:

In order to shop on the SITE, the user needs registration. Once registered, he can change his data in the relevant section.

In order to obtain the right to place valid orders for the purchase of the goods offered on the SITE, the user must have correctly filled out an online form located on the SITE. When filling out the form, the user is obliged to provide complete and correct data regarding his identity and other data required by the electronic form, as well as to update them within 7 days of their change.

The user guarantees that the data he provides during the registration process is true, complete and accurate, and if the latter changes, he will update them promptly. In the event that the user provides false, incomplete or inaccurate data, or subsequent changes are not reflected in the data, URBAN DESIGN Ltd. is not responsible for inaccurate performance of the contract and, in addition, has the right to stop immediately and without notice the maintenance of the user's registration and access to his customer profile.

Before placing an order, the user can freely correct the information entered by him in the registration form.

  1. CONCLUSION AND IMPLEMENTATION OF A PURCHASE-SALE AGREEMENT

The price indicated in the Electronic Store, as well as commercial discounts and promotions, are valid only when concluding a contract through the Electronic Store.

An order for a product cannot be made without prior acceptance of these General Terms and Conditions, which is carried out in the manner indicated above - by pressing the "I agree with the General Terms and Conditions" button.

The user can order the selected goods by adding them to the cart and pressing the corresponding button after entering the relevant information. The payment method must also be selected.

If incorrect or incorrect data is provided, the user loses the right to receive the order.

By pressing a button explicitly indicating "PURCHASE", it is considered that the order has been placed and the contract for the purchase of the selected goods has been concluded.

The Supplier and the Users conclude separate contracts for each separate purchase and sale of goods/s that are requested by the Users, regardless of whether they are selected with one electronic statement and from one list of goods for purchase.

The ordered goods can be ordered together or separately, with each item having a separate sales contract.

The user can pay the price for the individual contracts for the purchase and sale of goods/s at once either when placing the order for the goods or upon their delivery.

For individual orders of goods that are not kept in stock, the prices of which are on request, an advance payment of 50% of the order value is required.

  1. COPYRIGHT:

The entire content of the SITE - information, data, resources, services, text, photo material, graphics - is the property of "URBAN DESIGN" OOD and/or its partners and suppliers, and is copyrighted. No part of this SITE may be reproduced in any form, for any purpose and in any media or computer environment without the express written consent of "URBAN DESIGN" OOD and/or its supplier partners. Any unauthorized use of the content will be construed as a violation of the Copyright and Related Rights Act, the Trademark and Geographical Indications Act and other applicable laws.

News on the SITE is intended for personal information only. Their use outside of this sense, such as publication, reproduction, any form of commercial use, as well as the transfer to third parties in full, partial or revised form without the knowledge and approval of "URBAN DESIGN" OOD is not allowed.

  1. GOODS:

The SITE offers the user the opportunity to make an online purchase of the goods specified in it. THE SITE provides a wide selection of goods from renowned and selected brands with detailed descriptions and photo material. The goods that are offered for sale through the SITE are original products of the trademark indicated on them.

The goods have the usual characteristics for the type of goods to which they belong, according to their ordinary purpose. In the event that a certain item has a special or specific characteristic, this is explicitly indicated when it is presented.

There may be certain differences (nuances) in the colors of the photo of the goods presented on the site and the actual (real) colors of the product. If such a difference exists, it is not intentionally created, but is entirely the result of imperfections in the reproduction process. For the same reason, there may be details that cannot be detected or are difficult to establish in the photograph. For products with an assortment of colors, delivery is based on availability or with a prior individual request.

The price of the goods is indicated upon presentation and includes all taxes and fees. The price of the goods does not include transport costs related to their delivery.

When choosing a payment method and confirming the order, the User undertakes to pay its final price. After successful completion of the order, the e-store system sends an email confirming receipt of the order.

  1. LIMITATION OF LIABILITY:

"URBAN DESIGN" Ltd. does everything possible to maintain true, accurate and up-to-date information on the SITE, without excluding the possibility of accidental objective discrepancies or omissions. "URBAN DESIGN" Ltd. is not responsible for the consequences, including possible damages, caused by or related in any way to the access, use or inability to use this SITE. "URBAN DESIGN" Ltd. is not responsible for the information (including its completeness and reliability) contained in other sites to which this SITE contains references.

  1. CONSUMER PROTECTION:

The user can cancel his order before it is prepared for delivery by calling or e-mail.

The customer does not have the right to withdraw from the concluded Contract upon delivery of goods/s made to individual order or according to his/her individual requirements.

Goods/goods that have been imported or delivered by individual customer request or wish are not subject to return or exchange.

The user has the right, without paying compensation and without giving a reason, to withdraw from the contract and return the goods received within 14 days from the day of receipt. The customer must provide the goods in a good commercial condition, with no missing parts parts included and together with receipt.

The right of refusal can be exercised by the user towards "URBAN DESIGN" OOD by means of a unilateral, unambiguous written statement of will or by means of the below-presented sample of Appendix No. 6 to the PPA. In the event that the user refuses an order, "URBAN DESIGN" OOD will reimburse him all payments that the company received in connection with the order without undue delay and in all cases, but not later than 14 days from the date of receipt of the notification of rejection, provided that the goods were received by the company within the same period.

"URBAN DESIGN" OOD may withhold the payment of the sums to the user in case of cancellation of the transaction, only and only until he receives the goods or until the user provides proper proof that the goods have been sent back to the company, depending on which of the two happened earlier.   1. LEGAL WARRANTY:

In relation to each consumer within the meaning of § 13, item 1 of the PPE, there is a legal guarantee of conformity of the goods with the sales contract for a period of two years. In case of non-compliance of the consumer goods with the sales contract, the consumer has the right to file a complaint, asking the seller to bring the goods into compliance with the sales contract.

  1. PRICES AND METHODS OF PAYMENT:

The final price of the order is the total sum of the prices of all products ordered, including the cost of delivery, indicated separately, if provided. All prices are in BGN including VAT and are not subject to change from the moment of ordering to the moment of payment.

By finalizing an order, the Buyer expressly accepts that upon confirmation of the order by the Seller, the Buyer will be obliged to pay the corresponding purchase price.

Purchased goods from the "URBAN DESIGN" OOD website can be paid for in one of the following ways: through a virtual POS terminal that works with BORICA, VISA and MasterCard debit cards, by cash on delivery and by bank transfer.

When making online payments or payments by bank transfer, "URBAN DESIGN" Ltd. does not bear any responsibility for costs incurred in connection with fees, commissions or other additional payments made by the Client or his bank on the occasion of the transaction itself, as and in cases of currency exchange, applied by the bank that issued the client's card in cases where the currency is different from BGN.

If the payment is made by an individual, not an invoice can be issued to a legal entity. If the Customer wishes his payment to be invoiced to a legal entity, he must make the payment from the account of the legal entity.

When selecting "Pick Up On Location", the customer agrees to pay a minimum of 50% of the order amount due in advance to the bank account listed on the SITE.

  1. DELIVERY (if applicable):

For each order placed by the User through the SITE - www.urbanconcept.bg, an employee of "URBAN DESIGN" OOD will contact him at the indicated telephone number or e-mail address to confirm the order placed.

It is also possible that due to our large portfolio of products in our Online Store, not every order can be fulfilled within 1 to 5 working days. It depends on whether the goods are available in our Central Warehouse or in our sales outlet or have to be manufactured or imported from another country. Our consultant will give you accurate information about the terms of execution and delivery of the order.

In the event that "URBAN DESIGN" OOD cannot fulfill the order due to the fact that it does not have the ordered goods, it is obliged to inform the customer about this in a timely manner (within the announced days for processing orders) about the delay by calling phone, SMS or email. If it is impossible to provide the ordered goods for orders paid by card, "URBAN DESIGN" OOD is obliged to inform the customer about this in a timely manner by phone call, SMS or email. (within the announced days for order processing) and to refund the amount within 14 days from the moment the lack is discovered.

Order fulfillment may be delayed for any of the following reasons:

  • Lack of availability of the ordered goods;
  • Incorrect or incomplete delivery address or telephone number for contacting the User.
  • If the User's payment is unsuccessful.

In rare cases, in case of insufficient availability of the requested products, there may be a delay or postponement of the delivery, and the customer is notified by an employee of "URBAN DESIGN" OOD about the delay by phone call, SMS or email. "URBAN DESIGN" Ltd. does not expressly guarantee the availability of the goods at the time of completion of the order.

The buyer, before finalizing his order, has the right to choose the way he wishes to receive the purchased goods from the Electronic Store - www.urbanconcept.bg . Purchased goods can be received in one of the following ways:

  • From the Central Warehouse of "URBAN DESIGN" OOD, located at the address: Mirovyane village, 1411, 55 Mirovsko shose street;
  • By courier delivery to the address specified by the Buyer or to a courier's office.

Important information for "URBAN DESIGN" OOD customers:

The team of "URBAN DESIGN" Ltd. tries to always maintain up-to-date information on the SITE. When changing product looks and content, a certain technological time is required for the information to be updated on the SITE.

The Customer may not use the Site to submit any material whose content is unlawful, false, misleading, threatening, inflammatory, abusive, abusive, defamatory, defamatory, obscene, pornographic, religious, or material that encourages conduct that would be considered a criminal offense and may give rise to civil or criminal liability or otherwise violate the law and morals. In the event that the Client does not comply with this obligation, the same shall bear full responsibility for damages caused to "URBAN DESIGN" OOD.
